On July 12, 2022, Kimberly Ann Mollicone, 49, was killed in a driveway shootout that started as a confrontation over an affair and ended with her husband behind bars.
Here's the disturbing case of Matthew Mollicone and the night a love triangle turned deadly in Ray Township, Michigan.
๐ A Confrontation Over an Affair
Matthew and Kimberly Mollicone drove to the home of Daniele Giannone, Kimberly's former lover, to confront him over a years-long affair. An argument broke out while Giannone was outside grilling.
๐ซ The Shootout
The confrontation exploded into gunfire. Giannone fired a warning shot over Matthew's head. Matthew returned fire, striking Giannone in the leg. As a wounded Giannone tried to retreat, Matthew kept firing. Giannone made it inside his house to grab a second weapon.
๐ฅ The Fatal Shot
Matthew went back to his Jeep, where Kimberly was waiting. As they backed out of the driveway, Matthew rolled down his window and fired again at the house. Giannone returned fire from inside. One round struck Kimberly in the neck. She died at the scene. Investigators later recovered three weapons and more than 30 shell casings.
โ๏ธ Who Gets Charged?
Defense attorneys argued Giannone should have faced murder charges, since ballistics showed his shot was the fatal one. But prosecutors charged Matthew Mollicone under the theory that he intentionally started the volatile confrontation and brought his wife into a situation he knew could turn deadly. Giannone was never charged โ officials ruled he acted in self-defense.
๐ Conviction and Sentencing
After an eight-day trial, a Macomb County jury convicted Matthew Mollicone in May 2024. In July 2024, he was sentenced on multiple counts: assault with intent to murder for shooting Giannone (12 to 40 years), voluntary manslaughter for Kimberly's death (roughly 7 to 15 years), and three felony firearm violations (2 years each, served consecutively). The sentences run both consecutively and concurrently.
Kimberly Mollicone was 49 years old. A wife caught in the crossfire of a confrontation her own husband started โ and didn't survive.
